    A few items do need clarification here: 1. A Seller’s Disclosure is filled out by the owner of the property, NOT the Agent. Items related to the home are commented on to the best of a homeowner’s knowledge. If items are deemed, “in need of repair “the Buyer has the option to solicit the Seller for a remedy to those items, if asked. 2. A home inspection was performed by the Buyer in a timely manner. The Buyer had opportunity to address any items upon the completion of the report. The report did find that the electrical to the Barn was disconnected at the panel. The possibility of needing a subpanel if the existing panel was too small was a call for an electrician In this case, the Buyer did not formally ask the Seller to remedy the electrical connection to the Barn. 3. The issue with the topsoil was disclosed to the Buyer by me to the extent that it was disclosed to me by the Seller. In conversation with the contractor who facilitated the soil transaction with the Seller, he stated that he had left 6-7 inches of topsoil and tilled the field when he was finished and planted Rye. Post close- The Buyer asked the Seller for money to bring in more topsoil. After speaking with the Seller she agreed to give her some money even though she was not obligated. The Buyer also insisted I contribute money, saying it was my fault that the soil amounts were not disclosed. As I stated earlier, It is the homeowner’s disclosure – not the agent’s. To this day there are 2 opinions on the condition in which the soil was left. The Buyer’s and the Seller’s contractor. My duty was to inform both parties of the mutually beneficial knowledge that was disclosed to me, and not my opinion.
